PhotoConnect Terms & Conditions

1. Introduction

“PhotoConnect” (“we”, “us”, “our”) operates photoconnect.pl (the “Service”). By accessing or using the Service, you agree to these Terms & Conditions. If you disagree, do not use the Service.

2. Definitions

  • Content: Any photo, description, comment, tag, chat, album, or metadata uploaded by users.
  • Deceased Person: A person marked as deceased in your uploaded content; only detailed data is shown for deceased or consented living persons.

3. Eligibility & User Conduct

  • Users must be 18+ or have guardian consent.
  • Do not upload content of living individuals without consent.
  • Inappropriate content (e.g. vulgar, pornographic) is prohibited.
  • Bot usage or scraping is forbidden.

4. User Accounts

  • You’re responsible for account security.
  • You’re accountable for all activity under your credentials.
  • Notify [email protected] immediately of breaches.

5. Contributions & License

You own rights to your uploads. You grant PhotoConnect a worldwide, non‑exclusive license to display, store, enhance, and share content with other users.

You retain ownership, but consent to internal use for features like photo enhancement and matching.

6. Face‑recognition & Matching

  • Uploading a photo enables face-recognition matching against our database.
  • All data processed according to our Privacy Policy (GDPR‑compliant).
  • You can enable and disable face-recognition related features using account consents.

7. Verified Places Program

  • User may submit a request for verification of photos. After successful review by our team, photos may be marked as “verified.”
  • Photos marked as “verified” are curated; they become a trusted historical reference.
  • Verified entries are locked; users cannot alter associated metadata.
  • Verification may be revoked on user request in any moment.

8. Premium Features & Payments

  • Basic features are free.
  • Premium features (extra search results, storage, enhancement credits) require payment.
  • Fees, renewals, cancellations, and refunds governed by local consumer laws.
  • We may modify pricing or features; existing subscriptions will remain unchanged until subscription term end.

9. Prohibited Uses

You must not use our Service to:

  • Violate laws (privacy, IP)
  • Harass, defame, or threaten others
  • Bypass security or reverse-engineer the Service
  • Publish unauthorized content
  • Publish Inappropriate content

10. Suspension & Termination

  • We reserve the right to suspend or terminate your account for EULA breaches.
  • You may delete your account and associated data anytime; residual copies may persist per backup retention and legal requirements.

11. Intellectual Property

  • We retain all rights to the Service, including software, trademarks, and logo.
  • Unauthorized use of our logo or copyrighted elements is prohibited.

12. Disclaimers & Limitation of Liability

Service provided “as-is”. We disclaim all warranties—no guarantee of accuracy, availability, or reliability.

We’re not liable for indirect or incidental damages. Liability is capped at fees you’ve paid in the last 12 months.

13. Dispute Resolution & Governing Law

This agreement is governed by Polish law.

Disputes to be resolved in Warsaw courts.

14. Changes to Terms

We may update these Terms at our discretion.

Users will be notified; continued use after updates constitutes acceptance.
